"IT
AIN'T FAIR, JOHN SINCLAIR"
The confidential informant report on the John
Sinclair concert included a transcription of the words to
"John Sinclair," "which song Lennon sang at
the rally. Source advised this song was composed by Lennon
especially for this event" (DE-4 page 3). The FBI
classified this transcription as "confidential"
and kep it secret for twelve years, even though Lennon
printed the same lyrics on the back jacket of his next
album, Some Time in New York City. The ACLU cited
this page in court arguments as evidence that the FBI lacked
a legitimate law enforcement purpose in its investigation of
Lennon, pointing out that it was not a crime to sing a song
about John Sinclair - it was a form of political expression
protected by the First Amendment.
